If you are a beneficiary of a Will, which means you are named in a Will to receive a gift, and there is some form of Will or estate litigation commenced in the Queensland Courts against the estate, the outcome is that you may receive far less money that what you otherwise could receive.
The Executor of the Will is duty bound to defend the estate from the Will dispute but unless they are defending their own personal inheritance. The opposition they provide might not be as strong as the defence you would provide to your own money being taken away.
There are a number of circumstances whereby separate representation for a beneficiary might arise. They are:
When The Public Trustee of Queensland or another trustee company is appointed as Executor;
When the Executor also wishes to defend their own personal inheritance but are only defending the money left to them, not the money left to all other beneficiaries named in the Will;
The Executor might be an independent solicitor or a family friend who would prefer to take a neutral position regarding any Will and estate dispute.
